1. Acceptance of Terms
By accessing or subscribing to PrimeTime Winners (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use our Service. These Terms constitute a legally binding agreement between you and PrimeTime Winners.
2. Description of Service
PrimeTime Winners is a subscription-based sports handicapping and analysis information service. We provide members with sports picks, statistical analysis, trend reports, and related content via our website and email communications. We do not accept bets, wagers, or any form of gambling deposits. We are an information service only.
3. Eligibility
You must be at least 21 years of age (or the legal gambling age in your jurisdiction) to subscribe to and use this Service. By creating an account, you represent and warrant that you meet this age requirement and that use of this Service is legal in your jurisdiction.
4. Subscription and Payment
The current subscription fee is $249.00 per month. Your subscription will automatically renew each month until cancelled. You authorize PrimeTime Winners to charge your payment method on a recurring monthly basis. All fees are charged in U.S. dollars and are non-refundable except as expressly stated herein.
4.1 Cancellation
You may cancel your subscription at any time by logging into your account dashboard or contacting us at support@primetimewinners.com. Cancellation will take effect at the end of your current billing period. You will retain access to the Service through the end of the period for which you have already paid.
4.2 Refunds
All subscription fees are non-refundable. We do not offer refunds for partial months of service or for unused portions of a subscription period. If you believe you were charged in error, please contact us within 30 days of the charge.
5. Use of the Service
Your subscription grants you a personal, non-transferable, non-exclusive license to access and use the Service for your own personal, non-commercial purposes. You agree not to:
- Share, resell, redistribute, or republish any content, picks, or analysis from our Service
- Use automated tools, bots, or scrapers to access or collect data from our platform
- Share your account credentials with any third party
- Use the Service for any unlawful purpose
- Reproduce or distribute our proprietary pick records or analysis without written consent
6. Intellectual Property
All content provided through PrimeTime Winners, including but not limited to picks, analysis, reports, graphics, and text, is the proprietary intellectual property of PrimeTime Winners and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.
7. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. PrimeTime Winners does not warrant that the Service will be uninterrupted, error-free, or that any specific results will be achieved from using our picks or analysis.
8. Limitation of Liability
To the maximum extent permitted by applicable law, PrimeTime Winners and its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation financial losses, arising out of or related to your use of the Service, even if PrimeTime Winners has been advised of the possibility of such damages. Our total liability to you for any claims arising from use of the Service shall not exceed the total subscription fees paid by you in the three (3) months preceding the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless PrimeTime Winners and its owners, employees, and agents from and against any claims, liabilities, damages, judgments, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any applicable law or regulation.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We are committed to protecting your personal information in accordance with applicable privacy laws.
11. Modifications to Terms
PrimeTime Winners reserves the right to modify these Terms at any time. We will provide notice of material changes via email or a prominent notice on our website. Your continued use of the Service after such notice constitutes acceptance of the updated Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Florida.
